General ArtWalk Rules and
Regulations

Artist must
personally attend his/her exhibit and be present during the entire ArtWalk
event. *Representatives may not attend in place of the artist. East Valley
Art Guild reserves the right to request photo identification to ensure
compliance with this rule. (*Exceptions to this rule may only be made in the
case of a physical illness or other limitation which would otherwise
preclude the artist’s participation and will only be granted through the
express written authorization of the ArtWalk director.) |

All work
exhibited must be original artwork produced by the artist and be reflective
of the slides submitted. No imports or manufactured goods. Artwork produced
with commercial kits, molds, patterns, plans, prefabricated forms or other
commercial methods is not permitted. No unlimited offset reproductions may
be exhibited. Only limited edition prints (limit 250), executed in processes
involving the artist, signed and numbered, will be permitted. 70% of
artwork, readily visible to the public, must be original, not prints. Prints
of photographs made from the artist’s negative must be processed by the
artist, or under his;/her direct supervision. |

East
Valley Art Guild retains the right to use slides, photographs, and artwork
submitted by the artist to East Valley Art Guild for use in advertising and
promotion of the ArtWalk, in this case, your slides, photographs or artwork
may not be returned. |
 |
It is East
Valley Art Guild’s sole obligation to furnish assigned exhibit services,
plus general lighting. Services of any other nature shall be requested by
the artist in writing at least 30 days prior to the ArtWalk.
There
is no charge for the public to attend. |
 |
Artist shall
be liable for delivery, handling, erection and removal of artist’s displays
and materials. All pertinent fire codes, laws, ordinances and regulations
pertaining to health, fire prevention and public safety shall be strictly
obeyed. Nothing shall be nailed, stapled, taped or otherwise affixed to the
wall, the ground or any part of the exhibition area in such a way to damage
the area. East Valley Art Guild prohibits the installation and operation of
any exhibits not meeting its approval. East Valley Art Guild, in its sole
discretion, may prohibit the conduct of any activity whatsoever which it
deems deleterious and not in the best interest of the ArtWalk. |

Set-up
for the ArtWalk may begin when all spaces in your area are marked correctly
and approved by the director. Due to parking restriction during ArtWalk
hours, set-up must be completed and all vehicles removed to designated
vendor parking areas by 6PM, the evening of the event. Thereafter, it will
be necessary for you to park outside the ArtWalk area and carry your display
in. ArtWalk hours are from 6PM to 9PM the 4th Friday of each month.

You will have to request that space in writing with reasons for the
request. |

Take-down:
To facilitate clean up and the needs of the retail business operating in the
center, all displays must be removed from the premises by 10PM on the
evening of the event. NO EXCEPTIONS! Let the ArtWalk staff know 30
days prior to the ArtWalk if you require assistance.
Booth
spaces must be left clean after the ArtWalk. |

East
Valley Art Guild will not be liable for refunds or any other liabilities
whatsoever for failure to fulfill these terms and conditions, due to the
unusable condition of the area in which the ArtWalk is to be produced,
caused by, but not limited to, fire or other calamity, any act of God,
public enemy, strikes, statutes, ordinances of any legal authority of any
cause beyond East Valley Art Guild’s control. Insurance must be obtained by
and at artist’s expense. East Valley Art Guild assumes no risk. |

Artist, will
be required to sign a Rules and Regulation form with the information from
this page. Signing the application, will hereby release and forever
discharge the East Valley Art Guild, Kimco Realty Corp., The City of Mesa,
De Rito Partners, Inc., and all sponsoring organizations and their
directors, officers, employees, agents and volunteers from any
responsibility, personal liability, claims, loss or damage arising out of or
in conjunction with his/her participation in ArtWalk. East Valley Art Guild
will not be responsible for any injury sustained by the artist and guests
while within space designated for exhibits. Further, artist understands that
he/she stores his/her artwork at his/her own risk. |

Artist is
solely responsible for the collection and remittance of sales tax to the
State of Arizona and the City of Mesa (a state representative may
contact you during the ArtWalk.) You must have submitted your paperwork for
your city sales permit prior to the ArtWalk.
The City of Mesa may be at the ArtWalk
and sometimes does check all DISPLAYS! |

No
waivers, modifications or amendments shall be valid unless approved in
writing by the directors or officers of the East Valley Art Guild. Venue for
all legal proceedings arising from violations of these terms and conditions
must be initiated in Maricopa County, Arizona. |

NO
FEES WILL BE REFUNDED AFTER ACCEPTANCE. All cancellations must be
received in writing. Registration Fees will be returned to all applicants
not accepted to the ArtWalk. The $25.00 application and registration fee and
$15.00 late fee are not refundable if accepted (DEADLINE is the Wednesday
before the Friday of the ArtWalk.
All payments, including checks must have cleared before you are allowed to
exhibit.
All shows
will go on rain or shine. The producer will not be liable for refunds or any
other liabilities whatsoever for the disruption of the festival due to fire,
or any act of God (including, but not limited to weather), public enemies,
strikes, statutes, ordinances or any other cause.
There is a
$35.00 fee for all returned checks.

Artist accepted into the ArtWalk will be assigned an exhibit location
number. Artists are not allowed to setup in any other location, or swap
assigned locations with another artist. |
 |
Tents are welcome and can be used by artists at the ArtWalk |
 |
Displays must be attractive, safe, and stable as to not fall or create harm.
The East Valley Art Guild will inform any artist with unacceptable exhibits
that they must remove them, or repair them. Failure to abide by the notice
will result in removal from the ArtWalk. |
 |
Artists may request electrical outlets for lamps, spots, and normal booth
lighting. Artists are required to supply their own electrical cords with a
multiplex safety outlet. Electrical will be normally be within 25 feet on
any exhibit location. |
 |
East Valley Art Guild does not allow alcohol in any exhibit booth, smoking
may only occur in designated area. |
 |
The East Valley Art Guild has the right to ask the artist to remove from any
display or exhibit, art that is found to be offensive, objectionable, or
overly sexual in nature. Artists doing "nudes" must be aware that this event
is deemed a "family event". All of us are artists and no one wishes to
become the art police, but to make the event successful , we must be careful
with displaying artwork that can hurt the reputation of the event and those
sponsoring or participating in the event. |

Unless
pre-approved, radios, tape players & televisions without headphones are
prohibited.

Do not
tear down booth or merchandise before the official advertised closing
time.
|

Exhibitors are expected to
present a friendly, positive attitude towards customers and other
exhibitors at all times.
Exhibitors should greet each customer in a friendly and welcoming manner.
Never ignore a customer. It is unacceptable to read a book, work on your
computer, visit with other exhibitors, or talk on your cell phone while a
potential customer is at your booth. You only hurt
yourself. |
